Terms of Service

These Terms of Service (the "Terms") govern your access to and use of services provided by Grand Rising Group ("Grand Rising Group", "we", "us", or "our"). By requesting an estimate, scheduling, or otherwise engaging with our services, you agree to be bound by these Terms.

1. Overview

Grand Rising Group provides residential services in Mitchell, SD & surrounding areas, including remodeling and plumbing services (such as flooring, decks, bathroom remodels, and kitchen remodels).

2. Estimates, Scheduling, and Process

  • Estimates: Any estimate provided is based on information available at the time. Final pricing may change due to site conditions, material selections, or scope changes.
  • Scheduling: Appointment dates are subject to availability and may be adjusted for weather, material delays, or unforeseen issues. We will communicate updates as needed.
  • Process: Projects may require permits, inspections, or third-party coordination. We will advise you on requirements relevant to your project.

3. Customer Responsibilities

  • Provide accurate information regarding project scope, property access, and site conditions.
  • Ensure a safe and accessible work environment during scheduled work hours.
  • Promptly review and approve selections, change orders, and notices to maintain project timelines.

4. Payment and Invoicing

  • Deposits: A deposit may be required to secure scheduling and materials. Deposits are applied to the final invoice.
  • Progress Payments: Larger projects may require progress payments based on milestones or time and materials.
  • Final Payment: Due upon substantial completion unless otherwise specified in writing.
  • Late Payments: Past-due balances may incur late fees and collection costs where permitted by law.

5. Changes, Delays, and Cancellations

  • Change Orders: Any change to scope, materials, or finishes must be documented and may affect pricing and timing.
  • Delays: We are not responsible for delays beyond our reasonable control, including weather, supply chain issues, or third-party performance.
  • Cancellation: If you cancel after materials are ordered or work has begun, you may be responsible for costs incurred to date.

6. Warranty

We stand behind our workmanship. Unless otherwise stated in writing, we provide a limited workmanship warranty consistent with industry standards. Manufacturer warranties for materials and equipment will apply as provided by the manufacturer. Normal wear and tear, misuse, and damage caused by external factors are excluded.

7. Disclaimers

EXCEPT AS EXPRESSLY PROVIDED, SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAND RISING GROUP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.

9. A2P SMS Text Messaging Terms

By providing your phone number, you consent to receive automated text messages from Grand Rising Group regarding quotes, scheduling, appointment reminders, service updates, and marketing messages. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. You can reply STOP to opt out at any time, and HELP for help. We will process your opt-out promptly.

10. Acceptable Use

  • You agree not to misuse our site, forms, or communication channels.
  • No fraudulent, abusive, or unlawful activity, including attempts to compromise security or disrupt operations.

11. Intellectual Property

All content, logos, and materials provided by Grand Rising Group are owned by us or our licensors and are protected by applicable laws. You may not use our branding or content without prior written permission.

12. Photos and Marketing

With your consent, we may photograph completed work for portfolio and marketing purposes. We will avoid including personal identifying details without permission.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of South Dakota, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in South Dakota, and you consent to jurisdiction and venue in those courts.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with any written estimate or work order, constitute the entire agreement between you and Grand Rising Group regarding the services and supersede any prior agreements or understandings.
